Terms of Service

These terms govern use of the Alex Does Digital website, marketing services, and Google Ads API integration.

Acceptance and eligibility

By using this website, engaging Alex Does Digital, or authorizing a connected account, you agree to these Terms of Service and the Privacy Policy. If you act for a business or another person, you represent that you have authority to bind them. You must be legally able to enter a binding contract.

If a signed proposal, statement of work, or other written agreement conflicts with these terms, that agreement controls for the conflicting subject matter.

Services

Services may include digital advertising strategy, Google Ads or other advertising account management, reporting, analytics, lead generation, conversion optimization, SEO, and related consulting or technical work. Scope, fees, timelines, deliverables, and approval processes may be set out in a separate proposal or service agreement.

No specific advertising result, lead volume, cost per lead, revenue, ranking, or return on investment is guaranteed. Platforms, auctions, competitors, markets, and user behavior are outside Alex Does Digital’s control.

Google OAuth and Google Ads API

The service may allow you to connect a Google Ads account through Google OAuth 2.0. By authorizing the connection, you instruct and permit Alex Does Digital to access and use the connected Google Ads account through the Google Ads API for the services you request. The requested Google Ads scope may allow both viewing and management of advertising accounts.

Authorized actions may include reading account and performance information and creating, editing, pausing, or removing campaigns, ad groups, ads, assets, keywords, audiences, budgets, bids, targeting, recommendations, reports, and conversion-related settings. Actual use is limited to the agreed services, your instructions, and permissions available in the connected account.

You retain ownership and control of your Google Ads accounts and are responsible for ensuring that account access is granted by an authorized person. You can remove OAuth access at any time through your Google Account connections. Revocation may stop connected features and does not itself cancel a separate paid service agreement or outstanding payment obligation.

Your use of Google products remains subject to Google’s applicable terms, including the Google Ads API Terms and Conditions, policies, account requirements, quotas, and enforcement decisions. Alex Does Digital is an independent service provider and is not Google, and Google is not responsible for services provided by Alex Does Digital.

Your responsibilities

You agree to provide accurate information, timely approvals, lawful content, appropriate account permissions, and any notices or consents required for your advertising and data. You are responsible for:

  • advertising budgets, platform charges, taxes, and third-party fees;
  • the legality and accuracy of your claims, offers, products, services, landing pages, customer lists, and instructions;
  • compliance with advertising, privacy, consumer protection, industry, and platform rules;
  • protecting your credentials and promptly reporting suspected unauthorized access; and
  • reviewing material campaigns, budgets, and changes when approval is requested.

Acceptable use

You may not use the website, services, or integrations to violate law or third-party rights; distribute malware; bypass security or access controls; misrepresent identity or authority; interfere with a service; scrape or reverse engineer protected systems except where law expressly permits it; or promote content prohibited by an applicable advertising platform.

Fees and payment

Fees, billing dates, deposits, ad spend, cancellation terms, and refund eligibility are governed by the applicable proposal or service agreement. Unless expressly stated otherwise, advertising-platform charges are paid directly by you and are separate from service fees.

Intellectual property

Each party keeps ownership of materials, accounts, trademarks, data, and intellectual property it owned before the engagement. Unless a written agreement states otherwise, Alex Does Digital retains ownership of its pre-existing methods, templates, processes, tools, and know-how. Upon full payment, you may use final client-specific deliverables for their intended business purpose, subject to any third-party license terms.

Confidentiality and data

Each party will use reasonable care to protect non-public information received from the other and will use it only for the engagement, except where disclosure is authorized or legally required. Personal information and Google user data are handled as described in the Privacy Policy. You must have all necessary rights and lawful grounds to provide any customer, prospect, or audience data used in the services.

Third-party services

Services may depend on Google, Meta, hosting providers, analytics tools, scheduling services, or other third parties. Their availability, policies, pricing, interfaces, and decisions are outside Alex Does Digital’s control. Features may change or stop if a provider changes or restricts its service. Links to third-party services do not create an endorsement or make Alex Does Digital responsible for their content or practices.

Suspension and termination

Access may be suspended or terminated when reasonably necessary to address nonpayment, security risk, suspected misuse, unlawful activity, a material breach, or a platform or legal requirement. You may stop using the website and revoke connected-account access at any time. Ending access does not erase obligations that accrued earlier. Data deletion requests are handled under the Privacy Policy.

Disclaimers

To the fullest extent permitted by law, the website and any software or connected features are provided “as is” and “as available.” Alex Does Digital disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these terms excludes a warranty that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, Alex Does Digital will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, advertising opportunities, or business interruption arising from the website, services, or third-party platforms. Any aggregate liability will not exceed the fees you paid to Alex Does Digital for the service giving rise to the claim during the three months before the event. These limits do not apply where prohibited by law.

Indemnity

To the extent permitted by law, you agree to defend and indemnify Alex Does Digital against third-party claims, damages, and reasonable costs arising from your content, products, services, data, instructions, unlawful conduct, or material breach of these terms, except to the extent caused by Alex Does Digital’s own unlawful conduct.

Changes to these terms

These terms may be updated to reflect changes in services, law, or platform requirements. The updated version will be posted here with a revised date. Material changes affecting an active service will be communicated when required by law or the applicable agreement.

General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these terms without written consent; Alex Does Digital may assign them as part of a reorganization or transfer of the business. Neither party is responsible for delay caused by events beyond reasonable control.
